Reviews and Appeals Against ARCP Outcome Decision

 

Review of ARCP Outcome 2

Where a trainee has been given an outcome 2 at their ARCP panel, they have the right to request a review of the decision.  A request for a review must be made to the chair of the ARCP panel via appeals.eoe@hee.nhs.uk within 10 working days of being notified of the decision.  The chair’s nominated deputy will arrange, as far as is practicable for all the original members of the ARCP panel to reconvene within 15 working days of the request for the review; this meeting can be held virtually.

Appeal against Outcome 3 or 4

In the case of an outcome 3 or 4 there is an appeals procedure which is outlined in the Gold Guide.  A request for an appeal must be made in writing to the Postgraduate Dean, via his nominated representative, appeals.eoe@hee.nhs.uk within 10 working days of being notified of the panel’s decision and the grounds for appeal must be stated.

HEE EoE will arrange a formal appeal hearing where practicable within 15 working days of the request for an appeal, or following completion of the review process.

An independent panel will be convened to form a judgement and will include:

  • Panel Chair – this will be the Postgraduate Dean or his nominated representative
  • College of Faculty Representative from an adjacent region
  • A Senior Doctor from the same region and specialty as the trainee
  • A Senior Doctor from the same region but a different specialty as the trainee
  • A Senior Trainee from the same region but a different specialty as the trainee
  • A Lay Representative

There will also be present but not form part of the panel:

  • HR advisory to the chair
  • Administrative support

Members of the original ARCP panel will not be a part of the appeals panel.  The decision of the appeals panel is final and there is no further right of appeal.

All reviews and appeals are recorded and a non-verbatim record will be taken by an administrator.
